Synopsis:
Steve Marsh, an organic farmer, lost his certification when his neighbour's GM canola blew over his fence. Despite attempts to settle the matter, there was no resolution available other than to take his neighbour to court. Long time friends ended up fighting in court. We now know that Monsanto funded the GM farmer in this David versus Goliath battle for the future of food and Steve's right to grow GM free organic food. Using the legal rights of common law trespass and nuisance Steve argued that his neighbour owed him a duty of care. The judge dismissed Steve's case prompting an appeal to the appeals court. The judgment is due sometime over the next six months.
